1. General Conditions
We reserve the right to refuse service to anyone for any reason at any time.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of the service, or access to the service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these terms.
2. Refunds and Cancellations
Refunds are assessed on a case-by-case basis. If it is an issue with the product, and Panacea Exchange is not at fault, we will pass your situation on to the supplier for further assessment. There is a refund window of 10 days after your order has been fulfilled, so please contact us as soon as possible. After this window has closed no refunds will be considered.
If you cancel your order before the order cut off date (12 pm on Wednesday for Friday deliveries, and 12 pm on Thursday for Saturday deliveries), you can receive a refund. Please email us at firstname.lastname@example.org.
Please be aware that our delivery service is a one-woman show! There are some things that are just out of our control, like weather and road conditions, as well as unforeseen traffic. If any circumstances happen in which your order is unable to be delivered, you will be notified immediately and refunded.
Currently the delivery area of Panacea Exchange is limited to Calgary city limits.
4. Security and Privacy
We collect only basic information from customers in order to process payment for your order: your name, email address, and address. Information is stored securely using our Wix back end system, and is never shared with other parties. We implement a variety of security measures to maintain the safety of your personal information when you access your personal information. Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company of any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product requested by the customer. If you are concerned about the information we collect and store, please contact us.
Suppliers will have access to your name and order, but no other information will be shared with them. We collect your address and use it only to make your delivery.
Addresses and payment information is collected using our third party payment processing system, Stripe. Please review their user agreement here. Panacea Exchange cannot access your personal bank or credit card information. Credit card information is always encrypted during transfer over networks.
Any of the information that is collected from you may be used in one of the following ways:
- To personalize your experience (your information helps me to better respond to your individual needs)
- The email address you provide for order processing may be used to send you information and updates pertaining to your order
- To improve our products and services based on the information and feedback received
- To improve customer service
- To process transactions
- To send periodic emails if you choose to subscribe to our newsletter. However, you have the ability to unsubscribe at any time.
5. Payment Terms
Payment is required in full before orders are processed and delivered. Stripe is used to process all payments on our website. Until a payment is confirmed to be paid in full, we will not release your order. All payments are made through secure encryption on Stripe and Wix Store’s networks.
We require a correct billing address for processing all orders. Incorrect information may result in an order being declined.
We charge 5% GST on all orders, as per tax requirements in Alberta, Canada.
6. Billing Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
7. Limit of Liability
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Panacea Exchange, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some provinces or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
COLLECTION OF PERSONAL INFORMATION
Personal Information is information about you that identifies you as an individual, for example, your name, address, e-mail address, or telephone number.
We collect information that you voluntarily provide to us through responses to surveys, search functions, questionnaires, feedback, online store purchases and the like. We may also ask you to provide additional information such as your e-mail address if you want to obtain additional services, information, participate in a contest or to resolve complaints or concerns.
HOW DOES COMPANY USE INFORMATION GATHERED ABOUT ONLINE VISITORS?
Before forwarding us any personal information, please be advised that any information gathered on our Sites may be used in the aggregate for research and development relating to our Sites and/or for future site development and, if you ask us to, to send you promotional materials. In particular, we may use information gathered about you for the following purposes: to monitor interest in our range of products and to assist us to tailor the content of our Sites to your needs by collecting information about your preferences through tracking of patterns page views on our Sites; to create a profile relating to you in order to show you the content that might be of interest to you and to display the content according to your preferences; and, in circumstances where you have indicated that you wish to receive additional information, to send you information about us and promotional material about our products together with details of any offers we may have available from time to time.
PROMOTIONAL AND INFORMATIONAL OFFERS
With the permission of an online visitor, information submitted at the time of registration or submission may be used for marketing and promotional purposes by the Company provided notice of this fact is made available online. If a visitor objects to such use for any reason, he/she may prevent that use, either by e-mail request or by modifying the registration information provided. The Company uses reasonable efforts to maintain visitors' information in a secure environment. If you have submitted personal information and want to change it or opt-out, please contact us as described below.
DISCLOSURE OF INFORMATION
The Company, in common with many web site operators, may use standard technology called "cookies" on its Sites. Cookies are small data files that are downloaded onto your computer when you visit a particular web site. You can disable cookies by turning them off in your browser; however, some areas of the Sites may not function properly if you do so.
PROTECTION OF CHILDREN ONLINE
The Company considers the protection of children's privacy, especially online, to be of the utmost importance. We do not knowingly collect or solicit personal information from children nor do we allow them to become registered users of, or to request information through, our Sites or help-seeking information lines.
ADDITIONAL TERMS FOR CERTAIN WEBSITES
The following additional information applies to our Sites that require registration. Generally, you are not required to provide personal information as a condition of using our Sites, except as may be necessary to provide you with a product or service that you have requested. However, some of our Sites are restricted to certain individuals such as health care professionals or our prescription drug patients and we may require these individuals to register upon entry by providing us with certain information.
